Florida Drug Possession Law: What You’re Facing

Florida Statute 893.13(6) makes it unlawful to possess a controlled substance without a valid prescription. The statute covers two types of possession. Actual possession means the substance was on your person. Constructive possession means the substance was in a place you controlled and knew about, such as a glove compartment in a shared vehicle. Constructive possession cases are frequently contested because the prosecution must prove both knowledge and control.

Offense severity depends on the substance and amount:
