Our client was sleeping in their vehicle which had pulled on the side of the road in a residential yard.  the police arrived and woke her up and ordered her out of the car.  she was then arrested for DUI.  The trial court suppressed all evidence holding that the police did not have sufficient cause to open the door of her car and order out.  The case was then dismissed by the State.
