DUI - The Crime/Administrative Process

Transcription:

If you've been arrested for DUI, you have a problem you have to deal with in two different places. DUI is a criminal offense and you have to challenge that and fight it in court. The suspension of your license is a problem that you deal with through the Department of Highway Safety and Motor Vehicles. Neither one has anything to do with the other. They're totally separate.

If you challenge the license suspension through the DMV and win that, that doesn't have anything to do with what happens in court and vice versa. You could win a DUI case and still be facing the administrative suspension of your license for refusing to take a breath test or having an illegal alcohol level.
